Step 1: Read and Accept Webmaster Rules and Agreement

Webmaster Agreement

This is an agreement between you, the Webmaster, and us, the Shameless Pimps Affiliate Program. You must read and accept this agreement before you sign up up as a Shameless Pimps Webmaster.

• Promo Materials: You may use only the promo materials found in the webmaster area, and only for marketing our sites. Marketing other sites on the same page as our sites is OK, as long as you’re not using our material as the main/only content of the page. Due to licensing requirements, we may not be able to make exceptions to this rule.
• Honesty: You will market our sites honestly, without lying to or attempting to deceive the customer or us. Do not use or promote popups, spyware, adware, virus, spam or similar nuisances.
• Respect: You will treat our models, employees, officers and webmasters with respect. Do not describe our models in offensive or derogatory terms, or use such terms on pages where you promote our sites. Which terms are offensive will typically vary depending on context – use common sense, and check the language on our sites as a guideline.
• Revenue Sharing: You will receive a percentage of all sales you refer and rebills on those sales, according to the current rate. The percentage is calculated on the gross sale price (e.g., before processing fees are deducted). In case of a refund, chargeback or other failure to collect the payment, you will not be paid. We reserve the right to terminate your account in case of excessive refunds or chargebacks. Referrals are tracked by CCBill, and CCBill’s tracking is final – even though there may be cases where CCBill is unable to correctly track the sale. All payouts are made by CCBill.
• License: You receive a limited, non-exclusive license to use Shameless Pimps trademarks, branding, banners, names, and so on for the purpose of promoting our sites according to the terms of this agreement. This license expires upon termination of your participation in the program.
• No Illegal Material: You will not promote any Shameless Pimps site on any site containing or linking to illegal material (including but not limited to illegal porn or illegal sharing of copyrighted materials or passwords), or containing or referring to underage, forced or violent sex or hateful speech, or containing depictions of persons that are or appear to be under 18 years of age.
• No SPAM: Do not use spamming or any form of email marketing to promote our program. This also includes spamming of news groups, forums, chat services, and networking sites like MySpace, Facebook, etc.
• Adults Only: All models on the Shameless Pimps sites are over 18 years old. You will not in any way imply that any model is or appears to be under 18 years of age, nor will you attempt market any adult site to persons under 18 years of age. The Shameless Pimps affiliate program is only open to adults over 18 years of age.
• No Link Fraud: You will not engage in any form of link fraud or manipulation of affiliate links, or any scheme where affiliate tracking codes get set without the customer knowingly clicking on a link.
• Loyalty: If you have any complaints about or disagree with how we run the affiliate program, you will contact us first and attempt to resolve the problem in good faith, rather than posting your complains to a webmaster board or other public forum.
• Termination: We reserve the right to terminate your affiliate account and this agreement at any time and for any reason. Likewise, you may cancel your account at any time. In case of serious breach of the agreement on your part, we reserve the right to withhold payment and file criminal and/or civil charges against you. Upon termination of this agreement, you must delete all of our materials in your possession and cease the use of all our marks, brands and so on (unless other arrangements are made).
• Small Print: We reserve the right to unilaterally change this agreement. Changes will be posted at the Shameless Pimps home page, and sent by e-mail to all current affiliates.
  In the event that any provision in this Agreement is deemed invalid or unenforceable, the rest of the provisions shall still be valid and enforceable.
  Our failure to enforce or delay in enforcing any provision in the Agreement shall not imply that we will not enforce said provision in the future, or that we condone breaking of or non-compliance with said provision.
  This Agreement constitutes the entire agreement between you and us, and supersedes any previous agreements. Any exceptions to this Agreement must be given in writing by an authorised officer of the Shameless Pimps Affiliate Program.
  This Agreement does not constitute a joint venture or partnership between the parties. We can not be expected to inspect and/or approve any of your websites or publications, even when you have informed us of their existence. You are solely responsible for the legality of your own sites, and that any promotional material obtained from us is acceptable and legal in your jurisdiction.
  NO WARRANTY: All material on this site is provided "as is" and without any warranty of any kind (to the extent permitted by applicable law), either expressed or implied, including but not limited to, implied warranties of merchantability, non-infringement of copyright, patents or trademarks or fitness for a particular purpose. The entire risk as to the quality, performance and personal satisfaction from the use of this material lies with you. No guarantees are made as to error-free and uninterrupted service or frequency of updates. We assume no liability for loss of sales in case of system down time, network outage or congestion or other event. In no event, unless required by applicable law, shall Shameless Pimps or its owners or providers be held liable for any damages arising out of the use, misuse or inability to use the material and information provided on this site, including but not limited to damages for loss of profits, loss of information, or any social, mental or health problems, even if Shameless Pimps, its owners or providers or other related parties have been advised of the possibility of such damages. In any case, any liability shall be limited to the amount paid by you for our services, except where such limitations are prohibited by applicable law.
  Indemnification: You agree to indemnify, defend and hold harmless Shameless Pimps, it’s owners, officers, employees, agents, affiliates, successors and any parties acting on their behalf from any and all claims, losses, liabilities, damages, or other expenses in connection with any claims arising from any breach by you of this Agreement or any other agreement you may have with us.
  Jurisdiction: Shameless Pimps is owned and operated by Netberries DA, a Norwegian company located in Bergen, Norway and registered in Foretaksregisteret with the number NO 990 237 425. This affiliate program, and the provisions of this Agreement are governed by the Norwegian Law, and in the event of a dispute arising or relating to the Terms and Conditions or the use or access to this site, litigation should be brought before Bergen Tingrett (Bergen District Court) in Norway.
